These terms and conditions apply to the nyborger app (hereinafter referred to as "Application") for mobile devices that was created by nyborger (hereinafter referred to as "Service Provider") as a Freemium service.

1. Acceptance of Terms

By downloading or using the Application, you agree to be bound by these terms. Please read these terms carefully before using the Application. Unauthorized copying, modification, or distribution of the Application or any part of it, including our trademarks, is strictly prohibited.

2. Intellectual Property

The Application and its entire contents, features, and functionality are owned by the Service Provider, including all trademarks, copyrights, database rights, and other intellectual property rights. You may not extract the source code, translate the Application into other languages, or create derivative works.

3. Modifications to the Service

The Service Provider reserves the right to modify the Application or charge for its services at any time. Any charges will be clearly communicated to you in advance.

4. Data Collection and Use

The Application stores and processes personal data provided by you to deliver the Service. For more information, please refer to our Privacy Policy.

5. Security

It is your responsibility to maintain the security of your device and access to the Application. The Service Provider advises against jailbreaking or rooting your device, which can compromise its security and functionality.

6. Third-Party Services

The Application uses third-party services that have their own Terms and Conditions. The links to these third-party Terms and Conditions are provided below:

7. Internet Connectivity and Charges

Some functions of the Application require an active internet connection. The Service Provider is not responsible if the Application does not function fully without internet access. If you use the Application outside of a Wi-Fi area, your mobile network provider's terms and charges will apply, including any roaming charges. The Service Provider is not liable for any such charges.

8. Device Responsibilities

You are responsible for ensuring your device is charged and functional. The Service Provider is not liable if you cannot access the Application due to device issues.

9. Disclaimer of Warranties

The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. The Service Provider does not guarantee that the Application will be uninterrupted, error-free, or free from viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, the Service Provider is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses arising from your use of the Application.

11. Updates and Termination

The Service Provider may update the Application to improve its functionality or to comply with legal requirements. You agree to accept these updates. The Service Provider may terminate the Application's availability at any time without notice. Upon termination, you must cease all use of the Application and delete it from your device.

12. Changes to Terms and Conditions

The Service Provider may update these Terms and Conditions from time to time. You are advised to review this page regularly for any changes. Continued use of the Application after changes are posted constitutes acceptance of the new terms.
